Complaints and requests to Suffolk Police, NCA, IOPC

Below is the latest letter from 22nd April 2019 I sent to my USA lawyer and others regarding this issues:



Unfortunately since I could not find a single person or organisation who would assist, OUT OF MORE THAN 800 contacted, I had to embark on dealing with the issues myself, so I sent a letter to Suffolk police: 

One month later I receive this email reply: 

Once again the police are willing (I would say encouraging me) to let me pick up my equipment  when i have categorically stated I do not want to take custody.

D.C Davey would appear incapable of understanding clear instructions and requests.

I inform them of this on a visit to the police station and then receive this email:

My request for chain of custody, imaging and examination records appear to have been ignored.

I therefore send this letter:

After 2 weeks still no reply so I send this letter:

A week later I get this in the mail:

I therefore sent a full complain to the IOPC 

A word about the IOPC first:

They were previously the IPCC but they were re-branded after being labelled ineffective and found to be hiring ex-police officers to investigate currently serving officers.


They currently mainly investigate 'how the police handled your complaint', NOT the actual complaint or as one adviser said to me;

' we would only investigate really bad things by the police, like murder or very bad corruption'

I am also informed verbally by someone who works at the IPOC, who was at least honest instead of avoiding answering, that:

'there is no one an individual citizen can go to who will investigate the police, it is the police themselves by referring the matter to the IOPC or a relevant body who decide if they are to be investigated.'

Finding this out did not give me much confidence anything would be done, as it suggests once again there is no one who can or is willing to investigate the police, but I will keep an open mind until I have a final reply.


I sent two almost identical letters through the IOPC.


The first to Suffolk/Norfolk police, the second to the NCA (National crime agency):

This is the initial response from Suffolk Police, so at least they have accepted the complaint.

But having someone from Lowestoft CID investigate, which is where D.C Davey works, isn't particularly reassuring in my opinion, so I send this:

My reply:


As you will notice if DS Steve Bunn's explanation is true there should be a 2nd report served by CCL and CCL also failed to find or disclose exculpable evidence.

SUFFOLK POLICE FINAL LOCAL RESOLUTION

The Claim in point 5 by DC Davey isn't actually true, so I send an appeal letter:

3 days later I receive information in the form of emails provided by Murry's solicitors which proves DC Davey was contacted, replied to some of them and that the information was requested (evidence provided can be viewed further down,  below my 25th March complaint), so I add to my appeal:

Despite providing evidence in my 21st December appeal addendum, this is ignored and not even mentioned in the final decision:

 I therefore submit another complaint about DC Davey, DS Bunn and Mrs M Speed:

I include the emails I previously supplied as proof that DC Davey was contacted and a request was made, but the information was not provided.

I receive this reply:

Despite the police lying, being deceptive and not taking into account evidence I provided in my first complaint, they consider it repetitive and a abuse of process, even though it is different complaint, concerning the way the police have acted to avoid being held to account.

I therefore send the whole file all to the IOPC on the 9th April 2019 and get this reply back:

As you see, one complaint is upheld and goes back to Suffolk Police. From which I get this back:

So I send in further representations:

And receive this in reply:

This responsibility was given to DI ADAMS of Suffolk Police

DI ADAMS contacted me and asked what I needed to resolve the complaint.

I will not display all the documents here as the communications that followed were essentially me asking for what I asked for in previous communications with Suffolk police and the NCA.

DI ADAMS was actually very helpful and provided me with continuity statements for my devices and further reports from CCL.

He would not provide me with the unused material in my case nor the original copies (clones/images) of my devices and once again directed me towards the NCA. (who of course have refused to provide me with anything)

Below are the significant extracts from our communications, plus a reply from the IOC, confirming it is only through the NCA that I am able to obtain this information.

I have now come to the end of the line with the complaints and requests to the local police and have the evidence I require to show that it is now the NCA who are responsible for providing me with the outstanding information I require.

               NCA RESPONSE 

The NCA are initially trying to hide behind the 'more than 12 months has passed'.

I therefore send further representations:

As you see, they have rejected my complaint because of the delay and say the appropriate office to appeal to is, THEM, the NCA!

This doesn't however put me off and I send this as my appeal:

Surprisingly just over 2 weeks later I receive this:

So I send the IOPC this:

This is the final response I get from the IOPC - As you can see even when it is a fact that an officer has destroyed data and not found and/or disclosed exculpatory evidence, the IOPC don't actually ask the NCA to supply any of the information regarding these issues and simply agree that too much time has passed.

Due to DS Bunn of Suffolk police response I complain about a second issue concerning CCL forensics.

As you can see the complaint was rejected due to it being 'repetitious' but the most worrying aspect is that there is no current way to complain about NCA contractors such as CCL.


A note about CCL forensics.


Their website states: 

CCL Group are led by CEO Andy Archibald, former Head of the National Cyber Crime Unit who works under the stewardship of Chairman and former Head of the National Crime Agency, Keith Bristow. 

Run by 2 ex police officers, in a particular one from the NCA.

Maybe why they also did not 'find' exculpable evidence and agreed with much of Lee Morgan Lewis' statements?

I will leave that thought there for now.
