SHORT OVERVIEW AND END RESULT OF MY EFFORTS.
This is a short condensed page to show the end result of complaints, my efforts and evidence I have accumulated.
The UK authorities have damaged computer equipment and potentially destroyed evidence I require to defend myself in a court case.
I have:
- Requested full copies from the NCA (National Crime Agency) through an SAR (Subject Access Request) of my data from my devices they should have taken upon seizure, examination records and disclosure of the actions taken by Lee Morgan Lewis who appears to be responsible for the destruction. The NCA have refused to provide me with anything.
- Complained to the IOPC and IOC (Independent office of Police Conduct / Information Commissioners Office). Both the IOPC and IOC have said the NCA have followed guidelines, and have refused to investigate nor compel the NCA to provide the information requested.
- Requested full copies of my data from Suffolk Police and the unused material in my case which should have already been provided to my legal team. Suffolk police have directed me to the NCA for this information.
- Complained to the ICO regarding this issue. The ICO have confirmed that Suffolk Police are not responsible for providing this, the NCA are.
- Sought legal advice in the USA regarding this issue. In particular what can be done legally in the USA regarding the destruction of evidence I require to defend myself. My attorney in the USA has stated that unless the USA authorities had some involvement in the destruction of my data/evidence it cannot be argued that I cannot have a fair trial.
- Been directed to a ECHR ruling (European Court of Human Rights). This addressed the human rights violation of a person not being able to have a fair trial after the destruction or loss of evidence.
- Sought legal advice on the steps to take to address the issues in 1-6. I have been advised I first need to take this matter to a tribunal (167 of the Data Protection Act 2018)
and through the UK court process,
including a Judicial review. At which point if these issues are still not resolved, I would then proceed to the ECHR.

Despite it being a potential ECHR human rights article 6 fair trial issue, Legal Aid refused me funding for this on two occasions!
Fortunately the barrister dealing with this issue very generously agreed to take on my case at reduced rate of what I could afford.
I believe I have now demonstrated how crucial it is for all these matters to be addressed; for me to obtain the information and data I require; and that it would be a violation of my human rights not to provide this and/or resolve these issues whilst I am still in the UK and under the jurisdiction of the ECHR.
